Terms and Conditions

Introduction

Use of this Service (the "Smart Pass") is deemed acceptance of the terms of this agreement without limitation. These terms and conditions apply solely to the Smart Pass Services owned and operated by ADBWC (Abu Dhabi Business Women Council’s established by federal law by decree No.3 of 2003 regarding the organization of telecommunications Sector, as amended.

Please note that UAE Government e-Services linked with Smart Pass may have additional terms and conditions regarding your use of UAE Government e-Services. Nothing in “Terms and Conditions of using Smart Pass services” is intended to modify UAE Government e-Services terms and conditions.

Your use of the Smart Pass Services and any resources provided by Smart Pass Services is subject to these Terms & Conditions, which form an agreement between you and the ADBWC regarding your use of Smart Pass Services.

Smart Pass Account

In order to create your Smart Pass account, and access certain Smart Pass and linked UAE Government e-services, you are required to register on Smart Pass to create a user name and password. You agree that the information you provide in connection with establishing your account is accurate and that you will keep your information up-to- date. You are solely responsible for the security of your user name, password, registration information, Emirates ID card and PIN and for any use of your Smart Pass account. You agree to notify ADBWC immediately of any unauthorized activity regarding your Smart Pass account or other breach of security. ADBWC may, in its discretion, suspend or terminate your Smart Pass account at any time with or without notice.

Smart Pass Services

The Smart Pass Services is inclusive of Federated Authentication service, Registration Self-service, Profile Management Self- Service provided by Smart Pass to the users of the Smart Pass website, Smart Pass kiosk applications, Smart Pass mobile applications and/or future Smart Pass service channels made available for the users.

Acceptable use

If the use of the Smart Pass Services by you or anyone using your account, violates these Terms & Conditions or any other ADBWC agreement or policy, or if it is - in ADBWC's sole discretion- objectionable or unlawful, or interferes with, disrupts or degrades the functioning or use of Smart Pass, without limiting any other right or remedy TRA may have, TRA may suspend, deny or restrict your access to the Smart Pass Services (and to take any other action TRA deems appropriate to protect TRA, and our users).

Without limiting the general policy stated above, you agree not to use the Smart Pass Services (including by linking to UAE Government e-Services), in any manner that:

  • is unlawful, invasive of another's privacy
  • infringes or misappropriates ADBWC's or a third party's intellectual property, confidentiality, or other rights;
  • compiles, uses, downloads or otherwise copies any user information and/or usage information (whether or not such information constitutes personally identifiable information), or that impermissibly transmits, provides or otherwise distributes such information to any third party;
  • decompiles, disassembles, reproduce or otherwise attempts to derive the source code for the computer systems and other technology that operate the any of the Smart Pass Services or that is available through the Smart Pass Services;
  • accesses (or attempts to access) any of the resources by any means other than through the interface that is provided by ADBWC.
  • You specifically agree not to access (or attempt to access) any of the resources through any automated script or routine, including "robots," "spiders," "offline readers," bots, web crawlers or other means, that accesses the resources in a manner that sends more request messages to servers in a given period of time than a human can reasonably produce in the same period by using a conventional user client such as online web browser, kiosk, and/or mobile application(s);
  • interferes with or disrupts the resources (or the servers and networks which are connected to the resources), whether via malicious software or otherwise; and/or
  • reproduces, duplicates, redisplays, frames, makes copies of, or resells the resources for any purpose.

Intellectual Property Rights

TRA owns and reserves the intellectual property rights in the Smart Pass Services and all of its information and material, including but not limited to text, documents, graphics, and information contained in hyperlinked files, (the "Published Information") The Published Information on the Smart Pass Services shall not be used for any commercial purposes, including but not limited to; selling, distributing, or republishing the Published Information.

Limitations of Warranties and Liability

The Published Information is provided on an "as is" basis, and the ADBWCgives no guarantees of the currency or accuracy of the Published information.

The TRA may amend or delete the Published Information without notice. The ADBWCdisclaims all express and/or implied warranties and conditions with regard to the Published Information.

The ADBWC shall not be liable for any loss or damage whatsoever and howsoever arising, directly or indirectly, from the Published Information or from use of the Smart Pass Services including the Website, Smart Pass kiosk applications, Smart Pass mobile applications and/or future Smart Pass service channels.

The ADBWC does not accept any responsibility for any loss, disruption or damage to data or computer systems which may occur from using the Smart Pass Services or the Published Material, and disclaims all express or implied warranties that the Smart Pass Services and/or the server that makes it available is free of malicious software.

Smart Pass Services users will hold harmless and indemnify the ADBWC from and against damages based in use of the Smart Pass Services or the Published Information.

Hyperlinking

The TRA may include hyperlinks to third-party websites on the Smart Pass Website. The ADBWC is not responsible for the content or reliability of these third-party websites and/or does not endorse the website linked to, (or any products and services referred to in that website).

Electronic Versions of Documents

The electronic versions of ADBWC documents published on the Smart Pass Services including the Website, Smart Pass kiosk applications, Smart Pass mobile applications and/or future Smart Pass service channels are for personal reference, research, information and/or educational purposes only. The definitive version of any ADBWC document is the original printed version held by the ADBWC. If the document has been signed by an authorized person, the definitive version is the original printed and signed version held by the ADBWC. In the case of any difference between documents, the version so held by the ADBWC shall take precedence over any other version.

English and Arabic Versions

Information contained in the Smart Pass Services are published in both English and in Arabic versions. Where there are any differences between the two language versions of the same information, the definitive version shall be the language version in which the information was originally issued.

Applicable Laws

This Term and Conditions document shall be governing by and construed in accordance with the laws of the United Arab Emirates. Any dispute arising under this document shall be subject to the exclusive jurisdiction of the federal courts of the United Arab Emirates.

Variation

The ADBWC may revise this Term and Conditions document without notice.

Entire Agreement

This Term and Conditions document constitutes the entire agreement between Services, users and the ADBWC in relation to use of the Smart Pass Services, and supersedes all previous agreements in respect of the same. ​
